The Wyoming Lottery (WyoLotto) Mobile App (the “App”) is designed to provide information about drawings, retailer locations, and ticket scanner capabilities. Location accessibility may be required for all functions to work properly. The App scanner will use barcode technology to determine whether Wyoming Lottery tickets may be non-winners or possible winners. The App is owned by the Wyoming Lottery Corporation (“we” or “us”), and we are granting you limited, revocable, non-exclusive and non-transferable license to use the App in accordance with these Terms and Conditions.

You acknowledge and agree that this license to use the App is provided to you as a courtesy and without charge.

The App is provided as-is and without representation or warranty of any kind, either express or implied, including (without limitation) any warranty of fitness for a particular purpose, accuracy, functionality, or non-infringement.

We strive to ensure all information provided in the App is accurate and timely. In the event there is a discrepancy, however, between the information provided in the App and the information contained in our databases or provided at an official Wyoming Lottery terminal, as applicable, shall be deemed official and final as it relates to any conflicting information provided by the App.

This license does not permit, and you will not, (a) reverse engineer, decompile, disassemble, or translate the App; (b) transfer the App or the license, whether in whole or in part, or grant any rights in the App or the license, whether in whole or in part, by sublicense or otherwise; (c) reproduce or distribute the App; or (d) modify or create derivative works of the App.

We will not provide your name, address, city, state, date of birth, or email address to any third parties except for our agents and vendors that assist us in marketing, promoting, developing Wyoming Lottery Activities (defined below) and fulfilling our Wyoming Lottery obligations. We will disclose your personal information to a non-vendor, non-agent third party only if ordered by a court or the Attorney General, or if otherwise required by law.

ELIGIBILITY

You must be at least 18 years of age or older to participate in Wyoming Lottery games, events or drawings and to use the App. By using the App, you acknowledge and agree that you are at least 18 years of age or older.

Employees or representatives of the Wyoming Lottery Corporation, its advertising agencies and vendors, and its and their spouses, children or any relatives residing in the same household as the employee or agent (the “WyoLotto Parties”) are ineligible to participate in Wyoming Lottery drawings, games or promotions that award prizes (“Activities”).

DISCLAIMERS

You agree that you will hold harmless and indemnify us and the other WyoLotto Parties from and against any claims or damages based on your use of the App.

8.

This Agreement shall be governed by and construed in accordance with the laws of the State of Wyoming, excluding its conflicts of law provisions. You and we agree that the state courts of the State of Wyoming shall have sole and exclusive jurisdiction over any disputes between you and us relating to the subject matter of this Agreement, and you and we expressly consent to the jurisdiction and venue thereof.

It is your responsibility to ensure that you understand the particular rules and guidelines for Activities posted at wyolotto.com before you participate in those Activities.

10.

Any participation in Activities is at your sole option, discretion, and risk. You acknowledge that in registering and participating in Activities you may have to provide us with certain personal details about yourself.

11.

By participating in Activities you agree you meet the following:

a.

You are not restricted by limited legal capacity;

b.

You are not classified as a compulsive gambler;

c.

All details which you give, or have given, in the process of registering at wyolottery.com or the App are accurate and that you will update your profile if there is any change in the information provided.

d.

WyoLotto shall not be required to release prizes to any drawing/contest/promotion winners until such time as WyoLotto has completed any necessary security, tax, legal or other reviews.

12.

We reserve the right to modify, upgrade, enhance or discontinue the App for any reason or no reason, with or without notice to you, and any such modification, upgrade, or enhancement shall be included as part of the App, as defined above.

13.

You are solely responsible for keeping your account password secure. You agree that you will not allow any other person or third party to use your account to participate in the Activities.

14.

A lottery ticket is a bearer instrument and must be presented to the Wyoming Lottery office or official lottery retailer for payment of a prize. All lottery prizes shall be awarded only after presenting the original, winning WyoLotto ticket. A photocopy or scanned ticket registered with the App will not be a valid ticket for presentation as a winner. All lottery games and players must abide and follow Wyoming Lottery rules and State Statutes.

15.

The Wyoming Lottery is not liable for any player’s computer or mobile device, including (without limitation) errors, omissions, malfunctions, or the availability of wireless or internet access.

16.

The Wyoming Lottery reserves the right to amend these Terms and Conditions at any time without notice to you. Such amendments will be effective immediately upon being posted in this ‘App Info’ section of the App. It is your responsibility to review the Terms and Conditions on a regular basis.
